Apparently Blackmon was speeding through a residential area, he was doing 60 mph in a 35 mph area, and he did not stop immediately when the police officer turned on the lights and sirens. When Justin finally pulled over a few blocks later he was alone in the car and the smell of alcohol was evident to the police officer. After a breathalyzer test in which Blackmon tested at 0.24, which is three times the legal limit of 0.08, Blackmon was arrested for aggravated DUI. In Oklahoma if a driver tests higher than 0.15 for BAC then the charge is aggravated, and can be charged as either a felony or a misdemeanor depending on prosecutor discretion as well as the facts in the case.
With a terrific career ahead of him as a NFL player Justin Blackmon needs to get his alcohol abuse issues under control. Since it is his second DUI charge hopefully the judge will order substance abuse treatment as part of any sentencing. Justin was released after spending several hours in jail and sobering up some, and his bond was in the amount of $1,000. There has not been any word yet from his new team and team mates, but it is a good bet that they are not happy with the latest events. With 2 DUI charges Balckmon may not have much wriggle room to plead the charge down, and the fact that he was so intoxicated will be a factor in any sentence given by the court.
