If the amount of marijuana possessed is between half and ounce and 1 ounce the penalty can be up to 1 year in jail and a $2,000 fine. Possessing more than 1 ounce of marijuana is a felony in North Dakota and this can bring up to 5 years in prison and a fine up to $5,000.
