In Idaho just being under the influence of marijuana is a criminal offense, and this can be punished by 6 months in jail as well as a fine of $1,000. These same penalties apply for public use of marijuana. Possession of up to 3 ounces is a misdemeanor and carries a maximum of 1 year in jail and a fine of $1,000. Selling or cultivating marijuana in Idaho has penalties that range from 1-5 years in prison, and quantities above 1 pound bring a mandatory minimum sentence of 1, 3, or 5 years depending on the amount involved.

 

Idaho also has supplemental laws concerning marijuana and other drugs. Being present where knowledge of drug activity occurs can bring 90 days in jail and a fine of $300. Possessing drug paraphernalia can mean up to 1 year in jail and a fine of up to $1,0000. A second offense for these charges will also double the penalty. Idaho marijuana laws also address selling marijuana when minors are present, and this charge is a felony, with the possibility of up to 5 years in prison and a fine of $5,000.
